Richard Gadd Says He “Could and Would” Testify in the ‘Baby Reindeer’ Lawsuit Against Netflix

As a dedicated fan of the art of storytelling and the captivating performances that bring these stories to life, I find myself deeply intrigued by the unfolding saga of Richard Gadd and Netflix’s “Baby Reindeer.” Being no stranger to the power of a well-crafted narrative, I am in awe of how Gadd has taken his own personal struggles and transformed them into a critically acclaimed series.

Richard Gadd, the inventor and lead actor of Netflix’s Emmy-nominated show “Baby Reindeer,” is ready to provide testimony for Netflix as they contest a $170 million lawsuit brought by Martha Scott, who is alleged to be her real-life counterpart.

1. In the lawsuit initiated by Fiona Harvey against Netflix, the actor isn’t listed as a defendant, yet they have supported the motion to dismiss the case through a statement submitted on Monday.

In the Netflix series, audiences became captivated by the tale of Donny, portrayed by Gadd as an up-and-coming comedian, who endured years of harassment, stalking, and relentless communication from a woman he had served at a London pub. This woman, named Martha, had previously served a five-year sentence for stalking in the production “Baby Reindeer.” Her actions escalated to threats and sexual harassment against Gadd, leading her to be imprisoned for nine months. The actor brings his authentic experiences to life in this show, which is adapted from his successful London West End play with the same title. A notice at the beginning of each episode confirms that this account is based on real events.

Social media users promptly identified Martha as the inspiration behind the character portrayed in “Baby Reindeer” based on old tweets from Harvey. In an interview with The Hollywood Reporter, Harvey admitted that the Martha character was modeled after her. However, she clarified that “Baby Reindeer” is not a true account of events and she has never been convicted or charged with stalking. She also expressed concern that her reputation was being tarnished without her consent, as no one had consulted her about the show’s accuracy or used her image with her permission.

Presently, Gadd has responded to the lawsuit with a detailed statement spanning 21 pages. In his own words, “I’m a comedian, scriptwriter, and actor. I conceived, penned, and performed in the Netflix series titled Baby Reindeer (the ‘series’). With firsthand knowledge of the facts mentioned below, I could effectively testify about them if required. This statement is submitted as evidence in support of defendants Netflix, Inc., and Netflix Worldwide Entertainment, LLC’s request to dismiss.”

Gadd clarifies that “Baby Reindeer” represents his personal journey with understanding his sexual identity and dealing with sexual abuse and harassment. However, it’s crucial to understand that this series is a dramatic work, not a documentary or an attempt at realism. Although the series draws inspiration from his life and actual events, it is not a verbatim account of the experiences he underwent at the time. Instead, it is a fictionalized portrayal that aims to convey emotional truth rather than factual accuracy.

A Scotsman shares his personal story involving Harvey, whom he encountered at The Hawley Arms pub in 2014. He characterizes Harvey as persistent and touchy, making him uncomfortable due to her frequent appearances at the establishment, which seemed to coincide with his work schedule. Over time, he notes that Harvey grew progressively aggressive toward him, bombarding him with thousands of emails, hundreds of voicemails, and several handwritten letters. These messages frequently contained sexually explicit, violent, offensive language, hate speech, and threats.

1. In addition to the series of emails or “exhibits” sent to Gadd by Harvey, the document provides them as well. Gadd describes his repeated attempts to contact the police regarding her behavior as it consistently disrupted his life, using the term “harassment.” He states that he frequently adjusted his daily activities to steer clear of her and avoided certain areas of London where he knew Harvey was often present (to this day, he remains anxious about visiting these parts of London due to her). However, Gadd fails to address the claim that some of Harvey’s key accusations are unfounded, such as her not serving jail time for stalking or never being convicted of stalking.

In his initial interview following the filing of the lawsuit, Richard Roth, Harvey’s lawyer based in New York, spoke with The Hollywood Reporter. He expressed eagerness to question Gadd and Netflix about the allegations brought forth in their production. “I truly believe that Netflix should be embarrassed,” Roth stated. “The notion that they label this as a ‘true story’ is false. This is not an accurate representation of reality. If Netflix insists on presenting it as such, then they hold responsibility for ensuring its authenticity.”

A Netflix representative told THR, “We plan to strongly contest this issue and support Richard Gadd’s ability to share his account.”
