For many people, the long-cherished dream of visiting Disney World often remains just that – a dream. However, reality can sometimes take a dark turn when fans finally reach their vacation destination. Regrettably, a visit to Disney World in Orlando turned fatal in 2023, as a woman lost her life after dining at one of the property’s restaurants. The victim’s husband has filed a wrongful death lawsuit against the company, and Disney+ is now part of the legal proceedings, with the corporation choosing not to participate in arbitration.
What Led To The Disney World Wrongful Death Lawsuit And Why Is The Company Avoiding Arbitration?
Even if you’ve never been to a theme or amusement park, it’s likely you’re aware that people often spend a significant amount of money on trips to Disney parks, hoping it will be an unforgettable experience. In October 2023, Dr. Kanokporn Tangsuan and her husband, Jeffrey Piccolo, had no idea that their meal at Raglan Road Irish Pub (located within the resort but privately owned and managed) would result in the doctor experiencing a severe allergic reaction and ultimately passing away while receiving treatment at a nearby hospital.
Eventually, Piccolo chose to bring a wrongful death claim against Disney, seeking $50,000. According to Deadline, Disney has chosen to abandon arbitration, following legal requests from Disney’s lawyers for the case to be thrown out of court so it could be settled privately. Now, Walt Disney Parks and Resorts is preparing to submit a document withdrawing the waiver for arbitration, allowing both parties to take the matter to court. In response to this change, Josh D’Amaro, Chairman of Disney Experiences, released a statement saying:
At Disney, we prioritize human compassion above all else, especially when faced with extraordinary circumstances like those present here. Given the profound grief this family has endured, we feel it’s appropriate to handle this situation with empathy and expedite a resolution. To show our support, we are foregoing arbitration and choosing instead to take the case to court.
It’s clear that this issue doesn’t connect in any way to the movies and shows available on Disney+ or the platform itself. However, if you’re curious about Disney’s involvement, it revolves around their asserted “right to arbitration.”
How Does Disney+ Factor Into Potential Arbitration In The Food Death Lawsuit?
Many people tend to skip over the detailed terms when subscribing to streaming or other services, so it’s possible that Disney+ users might not have noticed that their agreement includes a clause stating all disputes with The Walt Disney Company or its affiliates must be resolved through arbitration instead of court litigation. Since Piccolo subscribed to Disney+ in 2019 and again in 2023, using his account to buy tickets for the Florida theme park, Disney’s lawyers initially contended that he had consented to arbitration in his wife’s wrongful death lawsuit.
As a dedicated gamer, I’ve been keeping an eye on some interesting legal news. Back in mid-August, when Disney’s lawyers requested arbitration, Piccolo’s attorney fired back with a court filing of his own. He didn’t mince words, calling the move “absurd” and saying it was “so over-the-top unreasonable and unfair that it would leave any fair judge shaking their head.” Essentially, Disney was trying to block its 150 million Disney+ subscribers from ever bringing a wrongful death case against them, even if the case had nothing to do with Disney+.
