Alec Baldwin to Be Deposed in Lawsuit From Halyna Hutchins’ Family Over ‘Rust’ Shooting

In May, I’m scheduled to give my statement regarding the unfortunate incident that took place back in October 2021 on the set of “Rust,” where I unintentionally fired a prop gun that led to the fatal shooting of Halyna Hutchins.

On behalf of Hutchins’ family members, their legal representatives have indicated in a document submitted to court in New Mexico this week, that they plan to question Alec Baldwin in person, on May 9th, at their law office in New York City.

Gloria Allred, a representative of the family, has stated that it’s past time for him to provide sworn testimony about the truth behind what led to Hutchins’ death.

The lawsuit filed by Olga Solovey (Hutchins’ mother), Anatolii Androsovych (Hutchins’ father), and Svetlana Zemko (Hutchins’ sister) against Baldwin, Rust Movie Productions, and the film’s producers alleges negligence in the set accident. The gist of the lawsuit is that they consistently disregarded safety measures intended to secure the safe handling of firearms on the set of the low-budget Western. According to the claim, Baldwin, who reportedly failed to verify if the gun was loaded contrary to standard industry safety procedures, cocked and fired the weapon despite the fact that the scene he was filming did not require him to do so.

The lawsuit claimed various offenses such as battery, intentionally causing emotional distress, negligence, and loss of companionship (which compensates for damaged relationships that depend on each other). Producers Ryan Smith, Allen Cheney, Anjul Nigam, Ryan Winterstein, and Matthew Delpiano, along with others, were also mentioned in the lawsuit. The original complaint was filed in the Los Angeles Superior Court but was moved to a New Mexico state court later on.

The trial for manslaughter against Baldwin was temporarily halted as it waited for its verdict. This pause was lifted when the court dropped the charges against him following a sudden hearing about how police and prosecutors handled certain bullets. This discussion revolved around a former law enforcement officer giving live ammunition to the Santa Fe Sheriff’s Office, some of which matched the bullets found on the Rust film set. Although these rounds were taken into evidence, they weren’t catalogued under the correct case number, thus concealing the evidence from Baldwin.

Additionally, Allred criticized Baldwin’s TLC reality show, starring himself and his family, due to its failure to acknowledge that he had removed a child from their biological parents.

Now that Alec Baldwin is no longer facing criminal charges, it’s past time for him to acknowledge and deal with the actual repercussions his actions have had on Halyna’s family members,” she stated.

In addition to representing Allred, script supervisor Mamie Mitchell is involved in a lawsuit against Baldwin and the film’s producers. Previously in this case, it was determined that Baldwin’s actions, which included accidentally firing a loaded gun with unawareness of a dangerous set environment on the Rust production, were “extremely and outrageously reckless.

In January, Baldwin filed a lawsuit against Santa Fe authorities accusing them of malicious prosecution and infringement on civil rights. He claimed they deliberately withheld evidence that could have proven his innocence and were attempting to bring charges against him for personal or political advantage in the case of the accidental shooting death.
