Erik and Lyle Menendez to Appear Before Parole Board in June

On June 13, Erik and Lyle Menendez are set to face the California Parole Board for a hearing, as announced by Governor Gavin Newsom on Tuesday. After the hearing, a comprehensive review of their conduct during their imprisonment and any potential risks they may pose upon release will be compiled. This report will then be sent to the office of the California governor and a Superior Court judge. Based on this assessment, they will determine whether the convicted murderers should receive a new sentence, potentially leading to their release, or if they should be granted clemency, remain imprisoned, or further proceedings may occur.

In 2023, the Menendez brothers, currently serving life sentences without parole for the 1989 murders of their parents, started exploring various legal options to secure their release. This was prompted by newly discovered evidence that bolstered their claim that they killed their parents in self-defense due to years of sexual abuse at the hands of their father, José Menendez, at their Beverly Hills residence.

Recently, three decades have passed since the second joint trial of these two brothers ended in a guilty verdict and two life sentences. However, opportunities to reconsider their sentences are dwindling. On Tuesday, the new District Attorney of Los Angeles, Nathan Hochman, chose to withdraw the request for sentencing recommendation for the brothers. This action was initiated because his predecessor, George Gascón, had submitted it in haste during an election campaign.

However, Hochman emerged victorious in the November election, and the newly appointed District Attorney has since stated that he does not find the case of the brothers warranting a retrial. The brothers have maintained that their parents intended to kill them in 1989, with the threat of exposing José as a sexual abuser of his own sons hanging over them.

If the Menendez brothers were ever to openly admit their guilt for all their criminal activities, concede that their claim of self-defense was false, and admit that their parents didn’t intend to harm them; furthermore, if they were to confess all these untruths not just to the court but also to the public, the District Attorney’s office, their own relatives, and acknowledge these lies as such, then the court might reconsider their case for rehabilitation and potential re-sentencing. Similarly, the District Attorney’s office would reevaluate their stance.

On Tuesday, during his podcast “This is Gavin Newsom,” Governor Newsom stated that Hochman’s decision to halt the resentencing appeal won’t influence his decisions regarding granting clemency to the brothers.

Mark Geragos, the brothers’ lawyer, stated during a recent interview with NBC News that the law will be obeyed, and if it is, then they (the individuals in question) should be released.

At this week’s press conference, Hochman brought up the premeditated act of the Menendez brothers killing their parents. He explained that after Jose and Kitty Menendez were fatally shot, it is claimed that the brothers subsequently shot them in their knees as a way to make the murders appear like a gang-related shooting.

In response to a question posed by The Hollywood Reporter, Robert Rand, who’s both a journalist and author of the comprehensive book on the long-lasting Menendez case, firmly denied the statement made as being highly inaccurate.
