A lawyer representing R. Kelly has submitted a powerful request in Illinois, asking that the R&B artist’s federal conviction for racketeering, sexual misconduct, and other offenses be overturned. The reason given is widespread prosecutorial corruption and manipulation of the main witness during the 2021 trial. Simultaneously, they are trying to secure home detention for their client amid allegations of a plot to arrange a murder involving North Carolina prison officials.
On Friday, attorney Beau B. Brindley submitted two requests: a Motion for a Retrial and an Urgent Application for Release Bond, on behalf of Kelly, aged 58. Currently incarcerated at FCI Butner Medium I in North Carolina, he is serving a cumulative 31-year sentence following his 2021 conviction for offenses under the Mann Act and RICO Act, as well as a 2022 conviction for child pornography production. The recent filing, pointing to fresh evidence, claims that prosecutors from the Northern District of Illinois have orchestrated a widespread effort to imprison Kelly. This campaign is alleged to be driven by these prosecutors’ relentless pursuit of Kelly, who was acquitted in 2008 on child pornography charges.
In their eagerness to take down R. Kelly as if they were crusaders for the Me Too movement, federal prosecutors and Bureau of Prisons officials have allegedly intimidated witnesses, obstructed justice, and violated Mr. Kelly’s constitutional rights, according to Brindley’s statement sent to The Hollywood Reporter. This motion uncovers the entire disturbing tale of their criminal actions in pursuing Kelly, as well as a plan to permanently silence him to conceal these crimes. We are determined to continue our efforts until Mr. Kelly is released from prison.
In the court case submitted to the U.S. District Court Northern District of Illinois Eastern Division, Kelly accuses prosecutors of using Bureau of Prisons officials and cooperating witnesses to illegally break laws, commit criminal acts, and consistently breach Mr. Kelly’s constitutional rights.
Following the rejection of an emergency plea by Kelly on Thursday by a federal judge for home confinement instead of prison, this significant filing was made. The disgraced music icon sought release from the North Carolina prison due to claims that officials from the Bureau of Prisons had coerced another inmate into attempting his murder. This week, Kelly was hospitalized due to an apparent drug overdose, as claimed by his attorney, who stated that he was given an excessive amount of medication while held in solitary confinement. When a two-week hospital stay was requested for a medical procedure, it’s alleged that BOP officials forcefully removed him from the hospital and returned him to solitary confinement. Furthermore, Brindley claims that Kelly is also suffering from blood clots in his lungs.
Brindley stated that he couldn’t manage to have a lawful conversation with Kelly until June 13, and that Kelly hadn’t consumed any food from June 10th through the 12th. This week, he submitted an emergency motion for house arrest. However, on Thursday, Judge Martha Pacold determined that this recent appeal was made to the incorrect court and clarified that she lacked the authority to make judgments about such allegations. On Friday, Brindley filed additional dramatic motions asserting that Kelly was a target of corrupt prosecutors and subsequently a deadly Prison Board, whose members are persistently trying to take his life.
Last Friday, Brindley’s office shared an abundance of legal papers with The Hollywood Reporter. Among these were documents that contained a signed statement, allegedly from Mikael Glenn Stein, a high-ranking member of the Aryan Brotherhood prison gang. In this statement, the inmate described performing tasks for the Bureau of Prisons in return for enhanced treatment and benefits within the prison system. He claimed to have worked under the direct supervision of a BOP official he referred to as “Childress.
Upon Childress’s instruction, I’ve arranged for numerous attacks and killings at different facilities, executed by Aryan Brotherhood members, following my commands. I’ve been part of some of these violent acts myself. In return for instructing and participating in this violence, me and other Aryan Brotherhood members have received unique benefits within the prisons we’re confined in. These perks include being exempt from searches, no disturbances to our cells, and the freedom to move drugs freely within the institution.
Stein, as stated in his declaration due to a Motion for New Trial, claims he knows individuals who he has instructed to be physically harmed or killed at the orders of the BOP. His statement details an incident in February 2023 when he was met by Childress and found himself in a prison meeting without any security present, along with USP Tucson’s Warden Gutierrez and Associate Warden Stangl. During this meeting, he was informed that he would be transferred to USP.
According to Childress, I was informed that I would be transferred to FCI Butner. He explained that my initial stop would be at the medical center, followed by a move to Kelly’s unit. Upon arrival at Kelly’s unit, Childress informed me that my task was to carry out actions against R. Kelly.
Despite initially planning to assist BOP officials further, Stein later changed his mind, as indicated in the written agreement. In conclusion, Stein wrote to the court that he is not disclosing all this information to aid Kelly, whom he believes should be held accountable for his actions following his high-profile trial and 2021 RICO conviction.
However, along with this firm belief, there were allegations of extensive corruption from the prosecutors and Bureau of Prisons (BOP), who stand accused of trying to kill Kelly. Yet, these wrongdoings remain unaddressed as they have not been brought to light.
Brindley’s office obtained a signed statement from Kishan Modugumudi, a previous inmate and roommate of Kelly, indicating that he was instructed to steal Kelly’s communications with his attorney and personal emails prior to the trial. This stolen legal correspondence was then utilized to provide an unjust and “unconstitutional advantage” to the prosecutors by offering them insights into Kelly’s defense strategy along with his legal team.
Ultimately, Kelly’s lawyer submitted a motion last Friday, which claims that prosecutors persuaded the main witness in Kelly’s 2021 conviction to alter her sworn testimony from his 2008 trial. In the original case, the woman who testified as “Jane” stated that she was not the person seen in a crucial video recording that served as one of the most significant pieces of evidence during the trial.
Over the past year, I’ve come to realize that the path leading to Jane’s 2021 testimony was built upon threats, hollow vows, illegal acts, and breaches of constitutional rights. In essence, it was the prosecutors who acted as the villains in this story, forcing an unwilling individual into the role of a victim to satisfy their ambition of bringing down R. Kelly – a prominent figure they aimed to tarnish. This was done under the guise of the Me Too movement, but through unscrupulous means such as criminal acts, threats, and manipulation.
According to Brindley’s filing, this situation represents the illegal manipulation of the Department of Justice for the purpose of targeting a prominent individual.
Recently, Brindley disclosed to the media that he intends to request a pardon from President Donald Trump for his client. Trump and Kelly (the client) have no previous connection, however, Kelly used to live at Trump Tower located within Chicago’s downtown area (The Loop district), until his arrest.
Regarding the ongoing legal matter, the Board of Prisons has chosen to remain silent about this case or any other related requests until the litigation is finalized. As of Friday evening, the U.S. District Court for the Northern District of Illinois has yet to release a statement concerning the motion and additional evidence.
