Once more, Roblox has found itself at the center of controversy. The latest issue arises from a popular dance on TikTok which unexpectedly appeared within one of their games without having been officially licensed.
2024 saw the rise of the “Apple” dance, a popular move that swept across social media, and its creator, Kelley Heyer, is now the plaintiff in a lawsuit. This dance was notably showcased during Charli XCX’s live performances as well.
According to Heyer, it’s claimed that Roblox adopted her dance routines for their Dress to Impress game, which was part of a Charli XCX-inspired update, despite the fact that the licensing agreements were still under discussion at the time.
As reported by Polygon based on court documents, it appears that Heyer had conversations with Roblox around the year 2024. These discussions revolved around licensing the “Apple” dance, as Roblox reached out to Heyer following the involvement of Charli XCX’s label in a collaboration.
In response to the agreement, Heyer expressed eagerness to grant the licensing for the dance starting from August 12. The dance quickly found its place in the game, even before a contract was finalized.
Reports indicate that Roblox continued to sell emotes up until November, with approximately 60,000 units sold and around $123,000 earned. However, Heyer claims she received none of the earnings from these sales.
In simpler terms, since Heyer filed her copyright application for the dance before it was sold as an emote on Roblox, her current legal claim is stronger than previous dance-related lawsuits which were rejected due to improper registration or vague arguments.
To put it simply, the entertainment business has faced numerous disputes over dance-related intellectual properties. Consequently, Roblox asserts that they treat intellectual property matters with importance and are confident in their approach to this issue.
A representative shared with Polygon that the platform is committed to backing creators and plans to argue this in court. However, Heyer’s lawyers argue that she was left with no other choice but to take legal action since Roblox refused to finalize the agreement.
Given that Roblox has a greater number of registered users than the global population, ensuring fair treatment for creators has become increasingly crucial.
For the time being, the “Apple” emote is unavailable, but the legal drama is far from over.
