Binance.US Wins Appeal Over Florida License Suspension

As a researcher with a background in finance and experience following the cryptocurrency industry, I find the recent court ruling in favor of Binance.US against Florida’s revocation of its money-services business license to be a significant development. The OFR’s suspension of Binance.US’s license following CEO Changpeng Zhao’s guilty plea to AML charges last November was hasty and lacked sufficient justification, according to the Florida First District Court of Appeal.


The First District Court of Appeal in Florida has overturned the decision made by the State Office of Financial Regulation (OFR) to revoke Binance.US’s money-services business license. The emergency suspension order issued by the OFR was ruled as unlawful.

In November 2023, the Florida Office of Financial Regulation (OFR) imposed a suspension after Binance CEO Changpeng Zhao admitted guilt to AML law violations in the United States.

The court made it clear that the OFR’s reasoning for suspending Binance.US’s license didn’t meet the legal requirements, as stated in the statute. Furthermore, the court pointed out that approximately 170,000 state account holders could face substantial financial losses if Binance.US was forced to sell its digital assets promptly.

Following Zhao’s heartfelt request, the Office of Financial Regulation (OFR) suspended Binance.US’s license a week later, making it the first state to do so. On March 25, Binance.US filed an unspecified appeal against the OFR’s decision. As per Binance.US, new user registrations have been put on hold by the state.

As an analyst, I’ve observed that Binance.US has faced suspensions or denials of license renewals in several states this year, including Alaska, Maine, North Carolina, and Oregon. The regulatory standpoints of Georgia and Ohio remain unclear to me. Notably, Binance.US never carried out operations in Vermont, Hawaii, Minnesota, New York, Texas, or as a bitcoin exchange.

The Florida situation underscores the ongoing challenges and regulatory hurdles Binance faces in order to persist with its operations in the US and various other nations.
