Actor Jay Johnston of ‘Bob’s Burgers,’ ‘Arrested Development’ Gets Year in Prison for Role in Jan. 6 Riot

As a long-time gamer who’s spent countless hours immersed in various virtual worlds, I must say that watching real-life characters like Jay Johnston, a man whose talents once brought laughter and joy to millions through his roles on shows like “Anchorman,” “Bob’s Burgers,” and “Arrested Development,” now find themselves in the midst of such a serious and tragic event, is truly disheartening.

A humorous performer, well-known for his roles in films like “Anchorman” and TV shows such as “Bob’s Burgers” and “Arrested Development,” was given a prison sentence of one year and a day due to his involvement in the January 6, 2021 assault on the U.S. Capitol.

After his arrest in June 2023, Jay Johnston admitted to a felony charge of hindering officers during a civil disturbance. Known for his roles in various successful TV series, Johnston was swiftly recognized among the multitude of Donald Trump supporters who invaded the Capitol following an incendiary speech by the former president at the nearby ellipse.

On January 5, 2021, as stated by the prosecutors, Johnston traveled from Los Angeles to Washington D.C. His actions during the subsequent attack are concerning. He confessed to having seized a police riot shield and using it to construct a barrier within a tunnel to defend against approaching law enforcement personnel. Additionally, he was involved in a group effort with other rioters that resulted in pinning a police officer against a door frame.

In their argument to the judge, the prosecution asked for a longer jail term for Johnston, stating that despite his admission of guilt, he had shown no signs of regret for his actions. To support their claim, they presented photographs of the actor with “QAnon Shaman” Jacob Chansley, another rioter who was given over three years in prison in 2022. The prosecution proposed a sentence of 18 months for the actor.

In a document they submitted, the prosecutors stated that the 18-month prison term is fitting given the seriousness of Johnston’s actions, which involved spreading false information about January 6th and his apparent lack of regret for taking part in the riot.

Following his recognition as a participant in the Capitol riots, Johnston lost his role on “Bob’s Burgers”, where he played Jimmy Pesto, the title character’s neighbor and restaurant rival. Earlier in his acting career, Johnston was both a writer and cast member for HBO’s unconventional comedy “Mr. Show with Bob and David” and made appearances on “The Sarah Silverman Program”. His legal representative stated that he has been shunned by Hollywood since being publicly identified as a Capitol rioter.

Attorney Stanley Woodward stated in court that since his detention, Johnston has been employed as a handyman. At the sentencing hearing, members of the actor’s family were present to attest to his character. His younger brother pleaded with the judge to take into account the professional harm Johnston is already experiencing when deciding on his sentence. Additionally, his fiancée addressed the court about their 13-year-old daughter who is autistic and heavily dependent on her father for care.

As a fervent admirer recounting the verdict, let me share that Nichols not only imposed a jail term of a year and a day on Johnston, but also mandated 40 hours of community service to be finished within a year post-release. Moreover, a $2,000 fine was ordered as reparation to the architect of the Capitol.
