Legendary action star James Bond, known for his daring exploits, has encountered various perils throughout his career… however, his latest test might unfold in the courtroom. This iconic secret agent is currently grappling with an unusual dispute concerning one of his most recognized possessions: his name. A property developer based in Dubai has filed claims in both the UK and Europe, alleging that the owners of “James Bond” are not making full use of the trademark across various products and services. If true, this could result in the company acquiring the rights to utilize the famous moniker “007”.
As per an article from The Guardian, the trademark for “James Bond” belongs to Danjaq LLC, a U.S. company that shares merchandising rights with Eon Productions. Currently, they are engaged in a battle to protect the name from infringement, as Austrian entrepreneur Josef Kleindienst has filed multiple requests aimed at canceling the trademark due to non-use. In the United Kingdom and European Union, if a trademarked merchandise name is not used for a span of five years, a challenge can be initiated to revoke ownership, allowing others to potentially use the name themselves.
It’s uncertain at this point what Kleindienst intends to do with the name “James Bond” if he wins, but it seems likely that it will be connected to the $5 billion luxury resort complex he’s constructing off the coast of Dubai. The report suggests that several iterations of the Bond name could potentially be available for use, such as James Bond Special Agent 007, James Bond 007, James Bond: World of Espionage, and even the famous “Bond, James Bond” catchphrase.
What’s in a Name? A Lot When That Name Is James Bond
If Danjaq loses the legal dispute, it’s hinted that the use of “James Bond” could expand into various product categories and services such as cars, software programs, digital comics, publishing, design, restaurants, bars, and hotels. According to a representative from Kleindienst, if they win, expect to see “James Bond” branding everywhere, with an announcement about these changes coming up soon.
Nevertheless, Mark Caddle, a partner and patent attorney at the European intellectual property firm Withers & Rogers, finds the legal challenge perplexing, expressing his confusion by saying, “Kleindienst seems to be a real estate developer based in Dubai, so it’s challenging to decipher his intentions regarding Bond in the UK and Europe. He must have some reason for this. It’s possible he’s attempting to pave the way for his own trademark application for Bond, which is a common strategy, but he hasn’t submitted one yet. In any case, Danjaq would undoubtedly contest such a challenge. James Bond remains widely popular and well-loved. I doubt that route would be an easy win for him [even if he were to succeed].
