As a long-time DirecTV subscriber and ardent sports enthusiast, I find myself deeply troubled by this ongoing dispute between my beloved service provider and Disney. The blackout of ESPN, ABC, and other Disney-owned channels has left me feeling like a fish out of water during the NFL season and the U.S. Open. It’s as if they’ve taken away my remote control and left me with static on the screen!
On Saturday, DirecTV lodged a complaint with the Federal Communications Commission, claiming that Disney has not been acting fairly during negotiations, as the blackout of Disney-controlled channels persists for a second consecutive week.
The FCC complaint alleges that Disney “has not acted fairly or honestly” during their negotiations, as stated by the relevant service.
Disney is found to have broken the FCC’s trust by making any licensing agreement contingent upon DIRECTV giving up all legal rights concerning Disney’s past, present, or future anti-competitive actions, such as its persistent packaging and minimum audience requirements, according to the statement.
The talks have hit a roadblock due to Disney’s persistent demand for combined offers and market access conditions that a New York federal district court judge recently deemed illegal, anticompetitive, and harmful to consumers in relation to the ‘Venu’ partnership. Essentially, Disney is pushing DirecTV to carry a wide range of programming, some less popular among viewers, while it offers more affordable, preferred selections of content. The Commission has yet to address a genuine complaint under such circumstances, and DirecTV might consider filing one in the future regarding Disney’s business practices.
Last week, a disagreement over carriage started between Disney and DirecTV as they couldn’t reach an agreement before their previous deal expired on September 1st. This led to several Disney-owned channels like ESPN and ABC being taken off DirecTV’s service. This situation has affected millions of customers, many of whom can’t watch the start of the NFL season, the U.S. Open, or even the upcoming debate between Kamala Harris and Donald Trump on ABC News on September 10th.
A Disney representative stated to The Hollywood Reporter that they are still working on resolving negotiations with DirecTV to reinstate access to their content as soon as possible. They encourage DirecTV to focus on their customers rather than distractions, and instead, finalize an agreement that would enable DirecTV subscribers to enjoy a robust selection of upcoming sports, news, and entertainment programming, beginning with the return of Monday Night Football.
