On Wednesday, the Department of Justice and the Federal Trade Commission launched a public investigation concerning the music concert and ticket sales sectors. They’re inviting the general public and involved parties to share their experiences with challenges encountered within this industry, along with suggestions for potential solutions.
The action follows a month since President Trump, accompanied by Kid Rock, signed an executive order on March 31 targeting the live music industry. This move includes demanding stronger enforcement to combat ticket scalper bots and also urging the Department of Justice (DOJ) and Federal Trade Commission (FTC) to submit a report within half a year, outlining suggestions for possible solutions.
Abigail Slater, from the DOJ’s Antitrust Division, stated that competitive live entertainment markets should benefit both artists and their audience. She emphasized that they will keep a close watch on this market, looking for chances to strengthen competition through rigorous antitrust enforcement. This could potentially make tickets more affordable for fans while ensuring fairer pay for artists.

Back then, the Department of Justice (DOJ), along with attorneys general from no less than 40 states, sued them. The reason? They claimed that Live Nation operates as a monopoly in the live music industry, thanks to its ownership of both the famous concert promoter bearing the same name and the gigantic ticketing company, Ticketmaster. Their demand? Split these two companies apart for fair competition.
Live Nation has consistently refuted the accusations, stating that the Department of Justice’s assertions divert attention from matters essential for enhancing the ticketing industry, particularly the need for stricter regulations to curb ticket resellers on the secondary market. The live music sector has been keenly observing Trump’s presidency to gauge the level of emphasis they might place on this lawsuit.
In response to the lawsuit, Dan Wall, Live Nation’s executive vice president of corporate and regulatory affairs, expressed that the Department of Justice isn’t addressing consumers’ genuine issues. He further stated that the government often appears to be resolving problems for people when in reality, they are catering to a specific set of political interests rather than the public at large, which may explain why public trust in the government has dwindled.
Rivals of Live Nation have reached an agreement with the company that the secondary ticket market has unfairly kept tickets away from genuine fans, as scalpers often profit excessively without benefiting the artists. However, they’ve also contended that breaking up the company could lead to a more competitive ticketing market for various businesses.
In the past few months, both supporters and legislators have become more outspoken about the Department of Justice (DOJ) persisting with its legal action. Recently, organizations such as the American Economic Liberties Project and the Break Up Ticketmaster Coalition wrote a letter to the department expressing their views on this matter.
In a predatory manner and by limiting competition, Live Nation-Ticketmaster has maintained its dominance in ticket sales. By eliminating rivals like concert promoters and customer-friendly ticketing services, they have expanded their presence across the industry, making an already challenging situation even worse,” the letter explained.
