This argument was subsequently prohibited from being raised in a second joint trial where they were both convicted.

This evidence is a letter found in a deceased relative’s desk, written by Erik Menendez, which detailed the daily mistreatment he experienced and was penned eight months before the murder of his parents. Balian asserted that the brothers had murdered their parents due to greed, backing up his claim with psychiatric notes stating it was not an act of self-defense. However, Mark Geragos, representing the Menendez brothers, dismissed these allegations.
