Last month, Gascón announced that he’d move for reconsideration of the decades-old case involving the brothers, who killed their parents in a salvo of shotgun blasts in the den of their Beverly Hills mansion. They’ve served 34 years in prison, exhausting all of their appeals in 2005.
A Los Angeles Superior Court judge has scheduled a hearing on December 11th to consider a proposal for the brothers’ re-sentencing to life imprisonment with the chance of parole. If approved, this recommendation would move forward to a parole board, who would decide if they should be released from prison. The brothers may become eligible for release immediately if the parole board agrees.
At a press conference, Gascón expressed doubt when asked if a new district attorney could reverse his recommendation. He stated, “I highly doubt that. Once it’s submitted, it’s submitted. The court now has jurisdiction over it.
Under District Attorney Gascón’s leadership, his office also wrote letters to Governor Gavin Newsom advocating for clemency. This action, as the brothers’ lawyer shared with TMZ, could potentially lead to their release by Thanksgiving, as it would eliminate the need for a resentencing process entirely. On a podcast, Newsom mentioned that he was informed by Murphy’s production team before the series premiere that it would spark renewed attention on the case.
Newsom recently spoke with the team responsible for creating the series, approximately nine months ago. They warned him, ‘Keep an eye on things following the release of this series, as it will spark much debate about whether these individuals should be freed or re-sentenced.’ Now, just a short time later, we find ourselves moving quickly in that direction.
The show was influenced by a TikTok trend where users shared evidence indicating that José Menendez may have molested a member of the ’80s boy band Menudo. This topic was explored in the Peacock docuseries Menendez + Menudo: Boys Betrayed, produced by Robert Rand, a journalist who found a letter written by Erik Menendez to his cousin Andy Cano supporting claims that he had been sexually abused.
Without Gascón in office, Los Angeles County may implement tougher penalties aimed at reducing crime levels. Hochman has spoken out against his successor’s policies, such as not prosecuting juveniles for minor offenses or pursuing enhanced sentences for crimes related to gang activities, which are extra prison terms added onto primary felonies associated with gangs.
As the election approached, a story emerged suggesting that Gascón’s tenure as district attorney contributed to a rise in regional crime rates. During his campaign, he emphasized that counties with traditional prosecutors, such as Orange and Sacramento, experienced more significant increases in violent crime. Conversely, this type of crime has been decreasing in L.A. this year.
In the contest, Gascón – a previous district attorney and police chief of San Francisco, who once served as an assistant chief in the LAPD – found himself up against significant challenges. With just two days left until the vote, he was 25 points behind Hochman.
