On Monday, Maurene Comey informed the court that she has become involved in the case. A seasoned attorney with nine years of service in the U.S. Attorney’s Office for the Southern District of New York, one of the most respected federal prosecutor positions in the country, takes on a case following successful efforts to keep Combs in prison prior to trial. On Wednesday, the court rejected Combs’ request for bail for the third time, arguing that no release conditions could guarantee the safety of the community. The court cited Combs’ alleged history of violence, which involves firearms, kidnapping, and arson, as a means to intimidate victims and witnesses with his extensive business network, as well as evidence suggesting he attempted to hide communications with people he is prohibited from contacting.

Marc Agnifilo, heading Combs’ defense team, has consistently contested the prosecution at every opportunity. Not only have they repeatedly requested bail, but in October, they also filed for a court order to prevent a potential jury from considering evidence that allegedly was leaked to the media by prosecutors. This evidence includes hotel surveillance footage showing Combs physically attacking singer Cassie. Combs asserts that the Department of Homeland Security released this video to CNN as part of a plan to secure an indictment from the grand jury and ensure he doesn’t receive a fair trial.

On Monday, the court ordered prosecutors to provide an affidavit confirming they weren’t the ones responsible for the leaks by Wednesday. Under a federal rule regarding criminal procedures, the government is not allowed to expose information that could disclose what occurred during grand jury hearings.

Prior to his role as a prosecutor, Comey spent time working as a clerk for a federal judge based in New York and also worked for a year at the prestigious law firm Debevoise & Plimpton.

Agnifilo, who has previously worked with federal prosecutors in a RICO case related to NXIVM’s Keith Raniere, has an extensive background in representing well-known individuals such as Martin Shkreli, Dominique Strauss-Kahn, and Roger Ng. He spent almost two decades working for Harvey Weinstein’s former lawyer, Ben Brafman. Agnifilo, along with another of Combs’ legal representatives, Teny Geragos, have a history of defending high-profile figures who have been accused of serious crimes.
