Gina Carano Likely Headed to Trial Against Disney Over The Mandalorian Firing

As a dedicated fan of Gina Carano and her exceptional work as Cara Dune in “The Mandalorian,” I can’t help but feel both angered and encouraged by the latest developments in her legal battle against Disney and Lucasfilm. It is disheartening to see an immensely talented actress, whose portrayal of Cara Dune brought depth and strength to the Star Wars universe, being targeted for expressing her political views on social media.

Gina Carano’s lawsuit against Disney and Lucasfilm over her termination from “The Mandalorian” is moving forward. On Wednesday, a federal judge rejected Disney’s attempt to dismiss the case (as reported by The Hollywood Reporter), bringing the dispute closer to trial. Carano is accusing Disney and Lucasfilm of wrongful termination. She believes she was fired because of her conservative political views publicly shared on social media. According to Carano, this action amounts to discrimination and infringes upon her First Amendment rights.

Disney argues that the First Amendment allows them to make the call in terminating Carano’s employment due to the need to safeguard their brand and hire individuals who fit their preferred public persona. According to Disney, Carano’s statements were not in line with this objective. However, Judge Garnett dismissed their appeal, stating:

I, as a defendant in this case, haven’t provided any proof in the complaint or elsewhere that we hire public-facing actors to promote values like respect, decency, integrity, or inclusion. Therefore, my argument that your presence among us as an employee is harmful and unconstitutional seems weak since there’s no solid evidence to back it up.

Garnett added that Disney didn’t provide a strong enough protection under the First Amendment in their argument. After hearing that Disney’s appeal was rejected, Carano took to X to show her appreciation for the chance to progress with her lawsuit. She acknowledged Musk’s backing and attached a 2021 conversation with Shapiro, a well-known conservative political commentator.

“I’m deeply emotional as I’m finally granted a chance in court after enduring a harsh 3 1/2-year ordeal. I’m profoundly thankful for this opportunity to defend myself before the judge and jury. The events that transpired were unjust, irrational, and abusive, and they should never have occurred. Let this be the end of such incidents for me and for others.”

In February 2024, Carano filed a lawsuit against Disney and Lucasfilm in a Los Angeles court, aiming for monetary damages and an order that would allow her to reclaim the role of Cara Dune in “The Mandalorian.” Elon Musk, then-CEO of X (formerly Twitter) and a prominent tech magnate, has publicly supported Carano and financially contributed significantly to her legal fight. This backing from Musk has empowered Carano to press on with the court case.

The lawsuit (via CBS News) opens:

Not long ago in a nearby galaxy, the Defendants enforced a strict uniformity of thought, expression, and behavior within their domain. Those who challenged this orthodoxy or fell short of complete compliance faced intolerance from the Defendants.

The lawsuit alleges that Carano was fired for expressing her personal views on social media and other platforms, as well as for standing strong against online bullies pushing a radical progressive agenda. Carano was let go from “The Mandalorian” after two seasons following a controversial post on social media in February 2021, where she drew parallels between being a Republican today and the Jewish experience under Nazi rule.

In the same month, Lucasfilm announced that they had let go of Carano due to her offensive social media posts. They strongly condemned a post where she made light of the Holocaust and equated it to mere political disputes. Previously, Carano had drawn criticism for expressing skepticism about wearing masks during the pandemic, promoting unfounded allegations of voter fraud, and changing her Twitter bio to include “boop/bop/beep” instead of showing support for the transgender community.

No trial date has yet been set.
