I, as a dedicated fan, shared the disappointment when Dave Navarro, Eric Avery, and Stephen Perkins of Jane’s Addiction took the surprising step of filing a lawsuit against their bandmate Perry Farrell on Wednesday. This legal action stems from Farrell’s notorious onstage clash with Navarro that ultimately led to the unfortunate cancellation of the band’s much-anticipated reunion tour.
Avery Navarro, Avery, and Perkins are suing for a total of $10 million in compensation due to losses they suffered following the event that led to the cancellation. Their lawsuit encompasses several issues such as intentional emotional distress, negligence, breach of fiduciary duty, contract breach, and for Navarro specifically, accusations of assault and battery related to the incident.
Avery Navarro, Avery, and Perkins are asking for $10 million because they claim they lost that much money as a result of the event causing cancellation. Their complaint involves several problems, including emotional distress caused intentionally, negligence, betrayal of trust (breach of fiduciary duty), breaking a contract, and for Avery Navarro, allegations of being physically attacked during the incident.
On Wednesday, a lawsuit was lodged in Los Angeles, which was subsequently examined by _The Hollywood Reporter_. This legal action follows closely on the heels of an incident from nearly ten months ago when Farrell struck Navarro during their band’s performance in Boston last September. The show was abruptly halted, and the remainder of their reunion tour was called off as the group disbanded.
In a lawsuit filed yesterday, attorney Chris Frost stated that Dave Navarro, Eric Avery, and Stephen Perkins were compelled to take legal action due to Perry Farrell, the defendant, physically attacking Navarro during a Jane’s Addiction concert. The assault occurred onstage, in the midst of the show, during their 33-date North American reunion tour. Farrell’s attack didn’t stop backstage, and it turned out to be a significant, fatal moment for Jane’s Addiction as a band and each individual plaintiff.
In the initial report published by Rolling Stone, the band alleged that at first, Farrell expressed remorse, but soon the story transformed into one where Farrell and his wife, Etty Lau Farrell, started shifting blame.
The representative for Perry Farrell stated that this recent lawsuit is merely another instance of the group targeting and intimidating him. They filed it only after they learned about our impending legal action. This move appears to be an attempt to manipulate public opinion, making themselves seem virtuous, a tactic that’s been used before. For instance, when they spread false accusations about Perry’s mental health and abruptly ended the tour without his consent, they did so again in an attempt to outpace the truth and salvage their reputation.”
Regarding the cancellation last year, Navarro posted on Instagram, “We cannot find a way that would guarantee a secure stage environment or consistently deliver excellent performances. Our hearts are shattered.
According to the lawsuit, Navarro decided to join the tour instead of continuing to receive $25,000 monthly disability payments due to long-term effects from Covid-19. The group was also working on a new album for distribution through Warner Music Group’s ADA, but due to Farrell’s behavior, completing the project has become impossible. This means that both parties may be personally liable for repaying the advance given to ADA.
Now, unfortunately, the Band will not embark on their comeback tour to mark a new album and over four decades of intricate, hit-making music, as previously planned. Instead, history may recall the band’s demise as a sudden and agonizing event brought about by Farrell’s unexpected rage and lack of restraint.
