Kim Kardashian’s Lawyer Has Spoken Out About The ‘Simple Mistake’ Made On Her Social That Claimed Man Was A Death Row Inmate. Now, He’s Suing

Kim Kardashian, renowned for her SKIMS clothing line, reality TV show (Season 6 of The Kardashians is set to air in 2025), and budding acting career, has been actively working towards criminal justice reform over the years. However, she’s found herself embroiled in a legal predicament of her own as an alleged “simple mistake” could lead to a defamation lawsuit. This stems from Kim sharing a photo on social media that incorrectly identified another man as being on death row.

Civil Complaint Accuses Kim Kardashian Of Mental Anguish After Social Media Mixup

In February 2024, Kim Kardashian shared a photo of Ivan Cantu from Westchester, New York, on her social media, erroneously labeling him as a Texas death row inmate with a similar name who was scheduled for execution. A civil complaint, not yet made public, filed with the Los Angeles Superior Court on February 20, 2025, alleges that this mistake caused significant emotional distress to the actual Cantu. According to the complaint, these events are said to have taken place.

Instead of Cantu experiencing severe emotional and mental trauma as emotional and psychological distress, humiliation, worry, sleeplessness, terrifying dreams, post-traumatic stress disorder, migraines, medical treatment, and emotional therapy, we can say that he underwent profound emotional and mental hardship, including feelings of embarrassment, anxiety, insomnia, recurring nightmares, PTSD symptoms, headaches, requiring medical intervention, and seeking counseling for his emotions.

In her social media update, Kim Kardashian mentioned Ivan “Abner” Cantu, a man who was found guilty of the 2000 murders of his cousin and his fiancee. He passed away via lethal injection on February 28, 2024.

In my own words, I’m currently involved in a lawsuit against Kim Kardashian, alleging various offenses including libel, slander, intentional emotional distress, invasion of privacy, negligence, and portraying me falsely as a double murderer. The legal documents state this accusation explicitly.

Kim Kardashian knowingly spread unverified information without proper permission or authorization, which was found to be irresponsible, careless, or against ethical and moral standards.

He is seeking damages in an amount yet to be determined.

Kim Kardashian’s Lawyer Says Misidentification Was A ‘Simple Mistake’

Kim Kardashian’s legal representative, Michael Rhodes, addressed the civil lawsuit by stating that the controversial social media post was removed following the identification of an oversight or mistake. Speaking to the Los Angeles Times, Rhodes made this clarification.

Apologies for any confusion, fellow cinema enthusiasts. It turns out that I unintentionally used a photograph of another gentleman sharing the same name during our promotion efforts for Kim’s relentless crusade towards criminal justice reform. Once the oversight was brought to my attention, I swiftly removed the image from circulation. Ideally, we’d like to resolve this amicably without resorting to legal action; however, rest assured that we stand ready to safeguard Kim’s reputation as required.

Ivan Cantu contends that even though his image was eventually deleted from Kim Kardashian’s social media accounts (with over 350 million followers), a case of mistaken identity had a severe impact on his reputation and subjected him to hostility. According to US Weekly, Cantu himself posted a statement on Facebook, expressing that this incident happened: “At the time, I said…

To everyone dear to me, I want to clarify that it’s not me who is being executed; unfortunately, someone running the account @kimkardashian mistakenly used a photo of Ivan ‘Abner’ Cantu instead of mine.

Prior to acing the baby bar exam in 2021, Kim Kardashian had already been actively engaged in prison reform efforts. In fact, as early as 2017, she took an interest in the case of Alice Marie Johnson, a prisoner serving a life term for a non-violent drug conviction. By collaborating with President Trump, Kardashian was instrumental in securing clemency for Johnson.

In another meeting, the head of SKIMS got together with Lyle and Erik Menéndez, who used to play tennis with Robert Kardashian Sr., as mentioned by Kris Jenner on an episode of “The Kardashians” (streamable with a Hulu subscription). This individual was backing their upcoming re-sentencing for the 1989 murders of their parents.

As for Ivan Cantu, we’ll have to wait to see if he gets his day in court.
