Newsmax Settles Smartmatic Defamation Lawsuit Over Election Lies on Eve of Trial

As someone who has spent decades watching and analyzing news channels, it’s refreshing to see accountability finally taking place. Newsmax, a channel notorious for its sensationalist and often misleading content, has finally acknowledged their error by settling a defamation lawsuit brought by Smartmatic. This is a step in the right direction, although I must admit I was surprised it took them this long to realize they were peddling lies.


Newsmax has resolved a defamation case filed by Smartmatic, stemming from inaccurate allegations they made about them during the 2020 presidential election.

An agreement was finalized on Thursday, following the commencement of jury selection. The specifics of the deal, which has postponed a trial set to begin with opening statements in the coming week, have been kept confidential.

Smartmatic’s lawsuit against Newsmax has been settled confidentially, according to a statement released by the company.

In a court case brought before Delaware Superior Court in 2021, Smartmatic accused Newsmax of spreading false claims that the company manipulated the election by altering votes. They claimed that Newsmax sought to attract viewers away from Fox News, whose ratings were decreasing after former President Donald Trump criticized the network for declaring Arizona for Joe Biden.

According to the complaint, “Newsmax understood they had an engaging piece of news that attracted viewers to their programs, thus Newsmax repeatedly broadcasted this story every evening.” The complaint also alleges that “throughout this entire process, Newsmax was aware that the story was false.

Smartmatic persists in filing a comparable defamation suit against Fox News, seeking approximately $2.7 billion in compensation. The trial is scheduled for the upcoming year.
