Prosecutors Push For Prison For Talent Agency Chief Alleged to Have Stolen Millions From Clients

The legal team suggests that talent agent Mark Measures, under investigation for embezzlement, could face a state prison term ranging from four to twelve years, having allegedly misappropriated approximately $1.8 million from his clients.

In Manhattan Criminal Court on Tuesday, Assistant District Attorney Rachana Pathak stated that it’s unlikely he can repay any of the debt owed to the numerous victims involved in this particular case.

KMR Talent Agency‘s owner and president, Measures, is accused of embezzling approximately $1.8 million from 160 New York-based actors, as well as around $26,000 from six employees between June 2021 and March 2024. The prosecution claims that Measures utilized this money, intended for clients’ escrow accounts, to cover personal expenses, settle debts, spa treatments at Four Seasons, clothing purchases, car payments, and at least $55,000 on Los Angeles Crypto Arena tickets.

In April, he was formally charged as part of a 40-count indictment. The charges encompassed one count of first-degree scheme to defraud, three counts of second-degree grand larceny, 28 counts of third-degree grand larceny, five counts of fourth-degree grand larceny, and three counts of petit (or petty) larceny. He has pleaded not guilty to these accusations.

On Tuesday, Danielle Von Lehman, acting as Measures’ legal representative appointed by the court, proposed a possible agreement between the involved parties within the next few months.

Von Lehman expressed his desire for us to find a solution, adding that what he truly wishes for is a outcome that doesn’t involve jail time.

Regarding the repayment matter, Measures’ legal representative stated that a single payment wouldn’t be feasible due to financial constraints, but there are potential job prospects that would allow for a structured payment plan instead. Present in court on Tuesday, Measures had traveled from California specifically for this hearing.

Beyond the over 160 individuals affected in New York, unfortunate incidents have also occurred in California and Georgia, causing a total of over 300 victims across the country, as reported by authorities.

Investigators have stated that they’re still getting reports from potential new victims, even up until last week. If these reports prove to be genuine, more victims could be included in the ongoing case.

Joe Gately, an actor residing in New York, who was previously represented by KMR, appeared at the hearing on Tuesday, also attending Measures’ arraignment. Gately had previously testified before the grand jury that resulted in Measures’ indictment. This was after he had worked on a national commercial, received initial payment and residuals for it, but later failed to receive the $6,500 owed from KMR when the commercial was renewed for a third time.

Following up on the matter, Gately disclosed that he had received a call from Measures, who allegedly mentioned they were encountering issues with their payment system. Subsequently, he got a check which unfortunately bounced. Later on, Gately took Measures to small claims court and emerged victorious, but has yet to retrieve the funds from them.

He stated, ‘I’ve been wronged, and I choose to remain present to make him aware of that. I haven’t forgotten what happened, and I believe he deserves a jail term for it.’ He expressed his support for the incarceration.

The upcoming court session regarding this case is scheduled for September 5th, presided over by Judge Brendan Lantry who recently took over the case. Judge Lantry has urged the involved parties to consider settling the matter beforehand. In case they fail to do so, a trial date will be established during that hearing.
