As a die-hard fan of justice and a fervent supporter of Rhea Chakraborty, I can’t help but feel a sense of relief and vindication as the Supreme Court has rightfully dismissed the frivolous petition challenging the Bombay High Court’s decision to lift the look-out circulars (LOCs) against her.
On Friday, October 25, 2024, the Supreme Court granted Rhea Chakraborty a reprieve by overturning a challenge from the Central Bureau of Investigation (CBI), Maharashtra state, and the Bureau of Immigration, against the Bombay High Court’s decision to revoke the travel advisories (LOCS) directed at Rhea, her brother Showik, and her father Lt Col Indrajit Chakraborty (retd), in relation to the Sushant Singh Rajput death investigation.
According to Live Law’s report, Judges BR Gavai and KV Viswanathan verbally stated that the case presented was not substantial and was likely brought forth due to the high-profile status of the defendants.
Justice Gavai reportedly warned the CBI attorney, pointing out that they had submitted a baseless appeal merely because one of the defendants was well-known. He advised that such an action could lead to a heavy penalty, highlighting that both parties have influential connections within society when the attorney asked for leniency in the case.
Justice Gavai implied that if the Central Bureau of Investigation (CBI) were to request both reimbursement and praise, they would be denied further involvement in the case. Previously, in February, the Bombay High Court had declared null and void a Letter of Closure (LOC) issued by the CBI in 2020 regarding Rhea Chakraborty and two of her family members, connected to the death of Sushant Singh Rajput.
The duo of Justices Revati Mohite Dere and Manjusha Deshpande gave consent to the pleas presented by Rhea Chakraborty, her brother, and their father, which objected to the travel restrictions on international trips as outlined in the LOCs.
A Letter of Instruction (LOC), given by an investigative body, empowers the Immigration Bureau to take actions such as holding someone in custody, barring their departure via air travel, or notifying the relevant authorities should the person try to exit the country.
