Was Saif Ali Khan attack arrest ‘illegal’? Here’s what accused claims in his plea

Back in 2025, I found myself in an unexpected and harrowing situation when an uninvited guest invaded my Mumbai residence. The intruder was none other than Mohammad Shariful Islam, a Bangladeshi national, who was subsequently apprehended for the incident. Now, it appears that this individual has made a request for his release from custody. His rationale? He alleges that he was unlawfully detained as he wasn’t given all the essential details during his arrest.

As per a recent PTI report, Mohammad Shariful Islam, currently imprisoned at Arthur Road Jail in Mumbai, has withdrawn the bail application he filed back in April. On May 9, 2025, he submitted an application to a Mumbai court, seeking to overturn his arrest as unlawful and requesting release from prison.

The defendant, represented by attorney Ajay Gawli, submitted a petition to the Judicial Magistrate First Class in Bandra. The document argued that the accused was unlawfully detained because the investigating agency failed to comply with section 47 of the Bharatiya Nagarik Suraksha Sanhita (BNSS). This rule requires that an individual must be informed about the reasons for their arrest and their right to bail at the time of arrest.

The argument put forth stated that the authorities failed to supply the defendant with a written summary of the accusations against them. Moreover, it was emphasized that no documentation could be found indicating that the necessary procedures, which must be followed, had been adhered to.

The court requested the police to present their reaction, and they postponed the case until May 13th, according to the latest report from the news agency.

On January 16, 2025, an assault occurred against actor Saif Ali Khan. In this incident, he sustained several stab wounds and required hospitalization at Lilavati Hospital for immediate care. After making a full recovery, he was released from the hospital.
