Netflix India summoned by NCPCR for 'unlawfully showcasing' explicit content on platform and its accessibility to minors

As a lifestyle expert with a strong background in child development and media literacy, I firmly believe that the protection of children from harmful content is of utmost importance. With my years of experience working in this field, I have seen firsthand the negative impact that explicit material can have on young minds. Therefore, I applaud the National Commission for Protection of Child Rights (NCPCR) for taking a proactive step towards ensuring the safety and wellbeing of children by summoning Netflix India over allegations of unrestricted access to explicit content on their platform.

The importance of content regulation on over-the-top (OTT) platforms is increasingly recognized, and India’s National Commission for Protection of Child Rights (NCPCR) is taking action. Following a complaint from Uday Mahurkar of the Save Culture Save Bharat Foundation, NCPCR chief Priyank Kanoongo has called for a meeting with Netflix India to discuss this matter.

What is the complaint following which NCPCR has summoned Netflix India?

A summons has been issued to Monica Shergill, VP, and Ambika Khurana, Policy Head of the streaming platform, regarding concerns about inappropriate content being accessible to minors on the platform. The notice, which includes a copy of the summons, has been shared on social media.

According to the notice, a complaint lodged with NCPCR claimed that Netflix was illegally broadcasting disturbing content featuring “nudity and graphic sexual scenes” between men and women, as well as same-sex couples and groups.

The streaming service has been accused of showing controversial scenes. One of these includes a man engaging in sexual activity with another man’s testicles, and another scene depicts a man ejaculating semen on a woman’s face. Minors can easily access this content on Netflix, according to the statement.

NCPCR acclaims there has been a violation of the POSCO Act

According to the commission’s assessment, providing unrestricted access to explicit content on Netflix for minors goes against Section 11 of the POCSO Act of 2012. In simpler terms, this law prohibits actions that involve encouraging a child towards pornography or providing any form of gratification related to it.

According to the notice, the National Commission for Protection of Child Rights (NCPCR) has requested that Netflix India attend a hearing on July 29 at 3 pm in person. The specific film or series under investigation has yet to be clarified by Netflix. Netflix provides access to content produced both in India and internationally, which can be accessed by those with subscriptions. One notable feature of Netflix is the ability to create separate profiles for minors to limit their exposure to explicit material.
