After the joint venture commences, those involved in the joint venture have no motive to engage in activities that could lead to the rise of direct competitors. Instead, they might be driven by the extended period of monopoly they’ve created for themselves to discourage competition and increase prices for both consumers and other distributors. However, even if the defendants claim they won’t actually do this (which, as we will discuss later, raises concerns), the purpose of antitrust injunctions is to prevent such anti-competitive motivations from arising in the first place. This way, American consumers aren’t left relying on their word alone and hoping for the best.

Based on Deadline’s report, the federal judge has granted Fubo’s petition to halt the debut of Venu Sports, referencing antitrust regulations as the reason. The accusations suggest that establishing such a media giant would further empower big corporations in the market. Despite Fubo being a substantial company boasting approximately 1.5 million unique subscribers, they argue that the emergence of Venu Sports could lead to an unjust monopoly, potentially crushing smaller competitors in the same sector.

Despite the judge’s temporary decision restricting Disney, Warner Bros, and Fox, their optimism remains high regarding the future release of Venu Sports. The judge believed Fubo had a strong case for the preliminary injunction due to concerns about the partnership’s potential monopolistic influence. However, fans eagerly anticipating Venu’s launch should not lose hope. No date has been set yet for the antitrust trial, but these companies are prepared to challenge the initial ruling.

The team associated with Venu Sports intends to challenge Fubo’s allegations, which they consider both factually incorrect and legally unfounded. Their ambitious plans for their sports package aim to drastically change how fans from all leagues experience sporting events. Initially slated for release in Fall 2024, a postponement appears likely due to an upcoming antitrust trial on the horizon.

Despite Disney and other partners’ confidence, Fubo TV maintains their conviction that the proposed bundle could potentially create an unfair monopoly situation. In their view, the effort to halt the debut of Venu Sports is primarily aimed at limiting consumer choices. Fubo TV CEO, David Gandler, went a step further in his criticism, alleging such practices as common among the companies involved, stating this as his reason for condemning the launch.

“For years, it’s been evident that The Walt Disney Company, Fox Corporation, and Warner Bros. Discovery have repeatedly employed anticompetitive tactics. In my view, these actions seem to be monopolizing the market, suppressing competition, and denying consumers their fair choice.”

Upon launch, Venu Sports is slated to be bundled with Disney+, Hulu, and Max.
