Director Joel Souza was also injured by the same projectile. Baldwin asserts that he did not intend to fire the gun, which was believed to contain a blank round. In March, Gutierrez-Reed was found guilty of involuntary manslaughter. Her legal team now argues that any misconduct leading to Baldwin’s case dismissal should be considered in her own trial as well. Last week, Judge Mary Marlowe Sommer dismissed the involuntary manslaughter charges against Alec Baldwin due to several crucial pieces of evidence being withheld by the prosecution. Specifically, they neglected to share that investigators had discovered ammunition from the film set, which appeared to contain live rounds akin to the one that resulted in Hutchins’ death. Sommer pointed out this lapse, along with numerous other procedural errors, as reasons why Baldwin’s legal team was unable to construct a complete defense.

She pointed out that finding this evidence late in the trial had hindered its full utilization, significantly affecting the trial’s fairness. The court ultimately dismissed the case against Baldwin permanently, signifying New Mexico authorities cannot bring the same charges against him once more.

This court should not tolerate such misconduct from the State.

At Gutierrez-Reed’s sentencing hearing, the judge scolded her for her role in loading live bullets into Baldwin’s firearm. This incident could potentially establish a more stringent threshold for obtaining a reversal of a verdict. In an analysis on Court TV, attorney Jessica Ehrlich highlighted the significance of the prosecutors’ misconduct. According to her, Gutierrez-Reed deserves a new trial in this case.
