In a California courtroom in Riverside, renowned director M. Night Shyamalan, known for movies such as “Signs”, “The Sixth Sense”, and “The Village”, is now involved in a legal matter where he will be defending himself against an $81 million lawsuit. The dispute centers around allegations that the concepts used in his recent work may have been copied from a relatively unknown independent film titled “The Truth About Emanuel“, which bears a striking resemblance to the hit Apple TV+ series “Servant”. Shyamalan and his team will need to present compelling arguments to prove their innocence.
The movie titled “The Truth About Emanuel” was directed by Francesca Gregorini, who noticed a striking similarity between her 2013 film’s plot and the storyline of a TV show that signified M. Night Shyamalan’s entry into television production. She filed a lawsuit against Apple TV+ in 2020, with the initial decision dismissing the case. Gregorini was subsequently ordered to cover the legal team’s costs, amounting to nearly $163,000. However, upon appeal, a new judge ruled that a jury would need to decide whether Gregorin, under the representation of Patrick Arenz, had grounds for claiming that the TV show had stolen her idea. Arenz argues, “The series ‘Servant’ wouldn’t exist without ‘The Truth About Emanuel’.
According to Variety’s report, M. Night Shyamalan made a court appearance but has not taken the stand as of yet. However, he is scheduled to discuss his role in the series. Alongside defense lawyers, Shyamalan will be accompanied by writer Tony Basgallop, Apple TV+’s head of programming Matt Cherniss, and producer Taylor Latham. The trial proceedings will commence once the jury views the initial episodes of “Servant” and the movie “The Truth About Emanuel”.

The film titled “The Truth About Emanuel” premiered on various film festivals such as Sundance, with Gregorini receiving a nomination for an award in the Dramatic category of the Grand Jury Prize. Despite this recognition, the movie didn’t garner significant popularity and soon moved to a home release. Unfortunately, this release didn’t generate much success or excitement, according to an article from Variety. The legal team asserts that the film only earned $226 in Los Angeles and a mere $9 in Philadelphia.
In “The Truth About Emanuel,” as penned by Gregorini, the narrative centers around a family trying to cope with the loss of their newborn baby. The father makes an unusual purchase – a lifelike doll that bears a striking resemblance to their deceased child. Overcome by grief, the mother treats the doll like it’s a real, living being. However, when an enigmatic nanny knocks on their door, a series of peculiar events unfold, causing the father to suspect that there’s something dark and unsettling about the appearance of this strange woman.
Emanuel, a young girl grappling with troubles, finds herself fascinated by her enigmatic neighbor, Linda, who looks remarkably like Emanuel’s late mother. Unaware of the consequences, Emanuel agrees to babysit Linda’s newborn infant. This action leads her into a delicate, fabricated reality, where she takes on the role of the guardian.
If you haven’t come across “The Truth About Emanuel,” it doesn’t make Shyamalan’s case simple because “Servant” shares some similarities with its plot. However, the jury will ultimately decide, but Arenz has already argued that having access to the movie shows Apple stole the idea. It was available for digital rental and allegedly provided to an Apple TV executive through a link. The potential positive is that due to the trial’s publicity, “The Truth About Emanuel” might receive the attention and exposure that an independent film typically lacks, regardless of the trial’s outcome.
