As a long-time sneakerhead and follower of The Shoe Surgeon‘s work, I was taken aback to learn about Nike’s recent lawsuit against him. It’s disheartening to see such a renowned figure in the custom sneaker scene being targeted by the brand.
In response to the expanding illegal market for sneakers, Nike has taken legal action against notable figures in this sphere, including Warren Lotas, John Geiger, and BAPE. These lawsuits aim to safeguard Nike’s brand and intellectual property. While the cases involving Lotas, Geiger, and BAPE have been resolved, a fresh lawsuit has emerged – this time targeting The Shoe Surgeon.
The Shoe Surgeon is famous for crafting high-end versions of popular Nike shoes. He sells customized designs and sometimes collaborates with others to create unique Nike-inspired sneakers, without Nike’s consent. Although they have tried to resolve this issue in private, Nike has taken legal action against The Shoe Surgeon, as reported by Sneaker Legal. Nike is not just concerned about the unauthorized use of their brand and designs, but also that The Shoe Surgeon teaches people how to replicate their trademarks at his classes.
The Shoe Surgeon didn’t reply right away when asked for a comment, but Nike provided this response instead:
Nike aims to ensure consumers receive genuine, authorized products that meet our stringent standards and deliver the desired performance. Regrettably, after multiple attempts to resolve this issue amicably, we’ve been compelled to sue The Shoe Surgeon for creating counterfeit Nike footwear from scratch and selling them as authentic merchandise. To shield our brand and intellectual property, and uphold Nike’s pledge to shield consumers from fake Nike goods, we have no alternative but to pursue a legal remedy.
Additionally, the Shoe Surgeon instructs people on how to manufacture fake “Nike” footwear. Such actions violate the law, mislead customers, and generate uncertainty regarding the origin, legitimacy, and standards of Nike shoes.
We appreciate our connection with the Shoe Surgeon and are content with the exclusive, customized shoes he creates for us and his other clients, as long as it complies with Nike-endorsed athletes’ contracts. In fact, we cherish chances for our athletes, consumers, and partners to showcase their unique expressions and artistic flair through their personalized footwear designs.
