On the evening of November 26, it was reported that Suchir Balaji, a previous researcher at Open AI, was discovered deceased in his San Francisco apartment. The media confirmed his identity over the weekend, and authorities have since determined his death to be a suicide, with no indications of any suspicious activity.

Balaji alleged that OpenAI, a firm specializing in artificial intelligence research and developers of ChatGPT, breached copyright regulations by using unique material during the training of their AI systems.

It’s worth noting that Elon Musk, one of the co-founders of OpenAI, has had a contentious split with the company management due to OpenAI transitioning from a research organization into a profit-driven entity.

In a recent interview with The New York Times, Balaji voiced concerns about OpenAI’s handling of copyright issues and their “fair use” policies regarding AI generative models that learn from artists’ original works.

As per Balaji’s explanation, there’s an apprehension that AI models developed by OpenAI might reproduce the very product they were trained on, under OpenAI’s “fair use” guidelines.

In Balaji’s recent statement, he explained that while generative models seldom create outputs identical to their training data, the act of training these models often involves duplicating copyrighted material. If these copies aren’t authorized, they might be seen as a violation of copyright law. However, whether or not generative AI can fall under the category of “fair use” is decided on a case-by-case basis, so it’s impossible to make a general rule about when such AI would qualify for fair use.

Open AI Faces a Bitter Battle with Musk and NYT

In a recent New York Times interview, whistleblower Balaji took part, as the news organization itself has taken legal action against the AI company due to copyright violations. As per reports in The Indian Express, court papers filed against OpenAI specifically name Balaji as someone with access to important and pertinent documents related to the case.

Currently, Elon Musk is taking legal action to prevent OpenAI from transitioning into a profit-driven corporation. Originally established in 2015 as a non-profit research organization dedicated to the betterment of humanity through AI, OpenAI and its co-founder Sam Altman disagreed on the shift towards profit-making in 2018, which led to Musk’s departure. Since then, OpenAI has transformed into OpenAI LP for financial gain, leading to an ongoing dispute with Musk.

In recent events, following Elon Musk’s lawsuit against OpenAI, the company has issued a comprehensive response, alleging that Elon had been attempting to acquire a controlling stake and take over the organization from its inception.

In a recent court filing, Elon Musk’s actions against OpenAI represent his fourth dispute in under a year concerning his claims. Yet, Musk’s own statements and actions suggest otherwise. Back in 2017, not only did he express interest, but he actively established a profit-driven entity as proposed by OpenAI. However, when he wasn’t granted majority ownership and control, he chose to withdraw, predicting our failure. Now that OpenAI has emerged as the foremost AI research lab and Musk heads a rival AI company, he is seeking the court’s intervention to impede us from effectively carrying out our mission, according to an OpenAI statement.
